John Wendland, on behalf of W&D, joined the Rocky Mountain Innocence Center in litigating a case and ultimately proving the innocence of a wrongly convicted man, Mr. DeMarlo Berry. Mr. Berry was convicted in 1995 at the age of 19 for the 1994 Las Vegas murder of Charles Burkes. Mr. Berry always maintained his innocence. Although there was no physical evidence linking Mr. Berry to the crime – no gun, no fingerprints, and no DNA – he was convicted and sentenced to life. RMIC, working with John Wendland and other attorneys, began a post-conviction investigation and litigation, eventually proving that Mr. Berry was completely innocent, resulting in his exoneration and immediate release from prison.
